Offer & Conclusion of Contract
The presentation of the products in the online shop is not a legally binding offer, but an invitation to order. Errors excepted.
Your order is a binding offer to Cluvig to conclude a sales contract. The receipt of your order will be confirmed to you by email (order confirmation). This order confirmation is not yet an acceptance of your offer. The sales contract is only concluded by an explicit order confirmation or by dispatch of the goods by us.
Please note that your purchase offer is legally binding.
Product availability
We always strive to keep all offered products up to date. To the best of our knowledge, wines displayed as available on the website at the time of your order are actually available. However, it may happen that a wine you have purchased is no longer in stock. If this is the case, we will immediately refund the amount for the pack that is no longer available.
Protection of minors
With your order you confirm that you have reached the age of 18.
The customer is obliged to ensure that only he/she or persons of full age authorised by him/her to receive the delivery accept the delivery of goods. Upon delivery, the commissioned logistics service provider is entitled to demand proof of age.
The persons entitled to care for or represent the minor ordering under false information are liable in accordance with the statutory provisions for all damages arising from the orders placed under false information.
Delivery costs
The delivery costs are calculated at the moment of entering your postal code. They vary according to the weight and size of the order, post code and real time costs for our service provider UPS.
We currently ship to Belgium, The Netherlands and Spain.
If you have specific order requests, please get in touch with us at leentje@cluvig.com so we can give you a customised quote for your delivery costs.
We always ship with UPS. If you are not present when the shipment is delivered by UPS, the shipment will be held at a nearby UPS pick-up point for five days before being returned to the shipper. You will receive an email from UPS informing you of the address of the pick-up point.
Please always check the shipment when it is delivered according to the enclosed delivery note. Any shortfalls in quantity or breakage must be reported to us immediately, otherwise we will not be able to provide replacement or compensation. Complaints of any kind should be addressed immediately to leentje@cluvig.com
Undeliverable packages
If a package is returned to us by UPS due to an error in the address provided, you will still be responsible for the delivery costs. This means that you have the choice of either having us resend the wines to a new address and you pay a new delivery charge, or we can refund your purchase minus the original delivery charge you’ve already paid.
Delivery time
We aim to ship orders placed before 10am on Sunday each Tuesday
The shipment should arrive by Friday or Saturday. If your shipment has not arrived the following Monday at the latest, we ask you to contact us. We will then clarify the status of your shipment immediately.
Cash discounts & bank charges
We do not grant discounts on credit card payments. Unauthorized cash discounts will be claimed.
Prices and payment methods
The prices at the time of the order by the customer apply. All prices are final prices, i.e. including the statutory value added tax.
Additional costs for special deliveries or costs incurred as a result of multiple delivery attempts will be charged to the customer.
We currently offer the following methods of payment:

Wine defects and natural cork
Some of the wines we sell are natural wines, which can deviate strongly from conventional wines. The aromas may be very unusual for inexperienced wine drinkers. Smells & aromas like “bread”, “horse stable” or “vinegar” are all possible. Natural wines can also be cloudy.
These and others are characteristics that are part of natural wines and are not a reason for us to refund them.
Due to the inconsistency of natural wines in general, all sales of wines on this website are final and wines that have been opened cannot be returned.
Natural cork is a natural material and therefore variations in quality are absolutely possible. We cannot be held responsible for any damage caused by cork taste. Winegrowers, traders and consumers have to deal with the problem of natural cork.
According to the new regulation of the European Consumer Rights Directive, your right of withdrawal generally ends automatically at the latest 12 months and 14 days after receipt of the goods by you, whereby cork complaints from purchases before this date are legally binding. Please understand that we do not replace bottles purchased from us more than six months ago.
Newsletter data
If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data will not be collected or will only be collected on a voluntary basis. We use these data exclusively for the dispatch of the requested information and do not pass these on to third parties.
The data entered in the newsletter registration form will be processed exclusively on the basis of your consent
You can revoke your consent to the storage of data, e-mail address and their use to send the newsletter at any time, for example via the “Unsubscibe” link in the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.
The data that you have stored with us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel the newsletter. Data stored by us for other purposes (e.g. e-mail addresses for the member area) remain unaffected by this.
Right of withdrawal
You have the right to revoke this sales agreement within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you who is not the carrier have taken or have taken possession of the last goods.

by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to revoke this sales agreement. In order to comply with the revocation period, it is sufficient for you to send the notification of exercising the right of revocation before the expiry of the revocation period.
Consequences of revocation:
If you revoke this sales agreement, we will reimburse you immediately and no later than fourteen days from the date on which we receive notice of your revocation of this sales agreement for all payments we have received from you, including delivery charges (other than additional charges resulting from your choosing a different method of delivery than the cheapest standard delivery offered by us). For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse a refund until we have received the Goods back or until you have proved that you have returned the Goods, whichever is earlier. You must return the goods to us (Cluvig – Carrer de Verdi 282-arico 1 – 08024 Barcelona Spain) immediately and in any case no later than fourteen days from the date on which you notify us of the revocation of this sales agreement. This period shall be deemed to have been observed if you dispatch the goods before expiry of the fourteen-day period. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to a handling of the goods that is not necessary for checking their condition, properties and functionality.
